Terms of service

The account

The account belongs to the lending business (the "business"), not to the person who creates it. The business is responsible for the users it adds, for what they do inside the platform, and for keeping their credentials secret.

You must be of legal age and have authority to bind the business you register. Billing and contact details must be accurate and kept current.

Plans and prices

• Personal: USD 20 per month, one user. Covers the full loan, customer and collections cycle, including the mobile app.
• Business: USD 50 per user per month, with a minimum of two distinct users so that four-eyes approvals can operate. Adds accounting, treasury, multi-branch and DGII electronic invoicing.
• Prices are in US dollars and exclude any applicable taxes. We may change them with at least 30 days' notice; the change applies from the next billing period.

Billing and payment

The subscription is charged monthly in advance through our payment processor. On the Business plan you are billed for the active users at the start of each period; users added during the month are charged in the next one.

If a charge fails we will notify you and retry. If the balance is still outstanding after the deadline in the notice, the account is suspended until it is settled: users cannot sign in, but the data is kept.

Cancellation

There are no long-term contracts. You can cancel at any time from the platform; cancellation takes effect at the end of the period already paid, and partial periods are not refunded.

After cancellation we keep the data for the period stated in the privacy policy, so you can export it and so that legal retention obligations are met; it is then deleted.

Your data

The data you enter into Credix belongs to the business. We process it as a processor, on your instructions and under our privacy policy, which forms part of these terms. Each business has its own separate database.

You are responsible for having a legal basis to process your customers' data and for honouring their rights under Law No. 172-13.

Electronic invoicing (e-CF)

When you enable electronic invoicing, the business is the issuer before the DGII. Credix signs the receipts with the digital certificate the business gives us, held encrypted, and submits them on its behalf.

The accuracy of the tax content, the validity of the certificate and compliance with DGII rules are the business's responsibility. Credix does not provide tax advice.

Acceptable use

• Use the platform only for lawful lending activity, in compliance with Dominican law.
• Do not attempt to access another business's data, bypass security controls, or deliberately overload the service.
• Do not resell, sublicense or offer the platform to third parties as your own service.
• Do not use the platform to harass debtors or for collection practices prohibited by law.

Availability and support

We work to keep the platform continuously available, but these terms do not guarantee an uptime percentage. We will announce scheduled maintenance windows. The mobile app is designed to keep operating offline during an outage.

Support is provided by email and WhatsApp during Dominican Republic business hours.

Intellectual property

Credix, its software, its brand and its documentation are the property of Pacificode LLC. These terms grant you a limited, non-exclusive, non-transferable licence to use it while the subscription is active. You acquire no other right over the platform.

Limitation of liability

Credix is a management tool: credit, collection and compliance decisions are the business's. To the extent the law allows, our total liability to the business for any claim related to the service is limited to the amount it paid us in the twelve months before the event giving rise to it.

We are not liable for indirect losses, lost profits, or data loss caused by misuse of the platform or by systems outside our control.

Changes to these terms

We may update these terms. Where a change is significant we will give at least 30 days' notice through the platform or by email. Continuing to use the service after that date means accepting the updated terms.

Governing law

These terms are governed by the laws of the Dominican Republic. Any dispute will be brought before the courts of Santo Domingo, unless the law provides otherwise.
